  1. Definitions
    1. The “products” / services provided cover language test and all the products and services offered for sale by Aviation eLearning on www.ilpt.net.
    2. The definition of a “User” refers to both natural as well as judicial persons who purchase or have purchased Aviation eLearning products on www.ilpt.net and anyone else using these services.
  2. Service Eligibility
    1. To use the product/service, you agree that: (1) you must be at least 1 years of age (minimum age); and (2) you shall register using your real name and provide us correct information. Creating an account with false information is a violation of our terms, including accounts registered on behalf of others or persons under the age of 13.
    2. If the applicable law requires that you must be older than 13 years old in order for us to lawfully provide the product/service to you without parental consent (including use of personal data), then the minimum age is such older age.
  3. Scope of terms and conditions
    1. These terms and condition of business shall form the basis of purchase of services/products offered on www.ilpt.net, unless otherwise agreed in writing between Aviation eLearning and the User.
    2. Aviation eLearning’ standard terms and conditions are not valid in the online business relationship between Aviation eLearning and the User.
  4. Concluding a contract
    1. The User will find the products/services for sale on www.ilpt.net
    2. From a legal point of view, the website is solely a platform to submit quotes.
    3. If a User wishes to purchase a product/service from Aviation eLearning on www.ilpt.net, the User concludes an order and payment procedure on the website, hereby submitting a purchase offer.
  5. Right to withdraw
    1. If the service has started, the User, by accepting these conditions, agrees that the right to withdraw within 14 days shall not apply.
    2. The service is defined as started in that moment the online payment has been completed. See also 10.1 below.
  6. Product /services provided
    1. Language Proficiency Testing – Aviation Language Online Proficiency Test.
      1. Aviation eLearning Online offers flexible personal access to online language test programs.
  7. Products on www.ilpt.net
    1. Aviation eLearning reserves the right to make changes or remove products/services from www.ilpt.net without prior notice. The User is not entitled to make any claims concerning these changes.
  8. Changes
    1. All purchases of language test products/services are subject to the availability of appropriate assessor staff. Furthermore, there may be changes in the assessment plan due to illness, staff changes etc. Aviation eLearning assumes no liability for the cancellation of test due to force majeure.
    2. If Aviation eLearning cancels a test or part of a test and does not offer replacement test within 4 weeks, the User is entitled to get a refund for the purchase amount. This also applies to language tests, which had to be cancelled by Aviation eLearning.
    3. The User is not entitled to replacement test or other compensation except as stipulated in 8.2.
  9. Results
    1. Aviation eLearning accepts no responsibility for the non-achievement of specific language test results. Guidelines published by Aviation eLearning, are based experience but may differ from user to user, depending on the individual’s background, motivation and skills.
    2. Contact to National Aviation Authorities (NAA) will be provided by electronic means after completion of test. If NAA so requires the test result will be sent to the User via email, so the User can provide the NAA with relevant documentation for test results and renewal of license.
    3. Failure of a test will apply to User achieving non-operational (ICAO grading 1-3 score) grade. The User holds the ultimate responsibility to contact the NAA in the State Of License Issuing (SOLI) for further actions. Achieving such non-operational grades will normally result in the User being unable to perform his/her flight duty. Failure of this obligation cannot be held against Aviation eLearning in any way.
  10. Appeal Procedure
    1. Users who are not satisfied with their result may request to be re-assessed by another language assessor. Appeals must be made in writing to info@ilpt.net no later than two weeks after the certificate has been dispatched.
    2. A fee of EUR 95,- may be charged for the appeal. If the appeal is successful, a new certificate is dispatched, and the User receives a refund of the appeal fee. If there is no change to the overall score, the a certificate with the same overall grade is issued, and the User does not receive a refund.
  11. Cancellation
    1. Once the payment has been completed and the Terms & Conditions have been accepted, the User per definition has initiated his/her test, no cancellation is possible.
  12. Refund
    1. If a User is unable to complete his/her language test no refunds for pre-paid test, nor registration fees shall be granted. Once the test is initiated electrical breakdown, interruption of internet connection, or any other phenomena outside the control of the User, the user shall resume the test at the point where the breakdown happened. Only in exceptional cases will a “re-test” without any additional payments be granted, but no refund of pre-paid amount.
  13. Pricing and payment conditions
    1. Prices listed on www.ilpt.net include the statutory value-added tax, with the exception of certain products/services that are exempt from value-added tax.
    2. Aviation eLearning reserves the right to change prices without any prior notice period, which, however, will not have any bearing on contracts already agreed on. The prices prevailing for products/services are stated on www.ilpt.net.
  14. Credit cards – security
    1. Aviation eLearning uses an external payment provider, the QuickpayTM platform, to process payment transactions with third-party companies. Aviation eLearning does not save credit card or bank data. The payment provider saves credit card and bank data in encrypted form. Payment shall take place by credit card or direct debit using QuickpayTM.
  15. Personal Data
    • Why do we hold personal data?
      Aviation eLearning needs to hold personal data such as user’s first andlast name, email address, phone number and address, to facilitate communication, deliver the service and customer support. Users’ personal information such as first name, last name, email address and date of birth are stored for billing and tax purposes. Aviation eLearning stores addresses that are necessary to complete the language certificate as required by Danish CAA. A copy of each certificate is stored due to Danish Transport, Construction and Housing Authority’s requirements.
    • How long do we retain test data?
      We retain the test data(recordings, ID verification) for 12 months after examination ends. 12 months is a time period that is necessary for assessment and potential reviews. A copy of a passport or other official ID and video footage from the test are stored for 12 months and then automatically deleted after they are no longer needed for the assessment and potential reviews. If a user has any complaints on their assessment they need to contact Aviation eLearning within 5 days after the assessment date.
    • How do we retain personal data?
      We retain the personal data entered during registration. The personal data come from the account registration form which is filled out by the User before the test is taken.
    • How do we process personal data?
      In accordance with the law on storing user data, users have the right to access and delete their personal data. If users do not wish to be sent Aviation eLearning’ information material, please notify Aviation eLearning Aps at email:cancel@ilpt.net. Your data will then be deleted. If a user wishes to claim their right to access the data, they can request access to their personal data by emailing Aviation eLearning at info@ael.aero.
    • How do we secure personal data?
      Aviation eLearning uses SecureSocket Layer (SSL) 256-bit hash with RSA encryption. Users’ files such as a copy passport or other official ID, video footage from the test and certificates are inaccessible to non-admin or non-examiner users. Personal data is not publicly accessible. All examiners signed a Non-disclosure agreement and passed the GDPR course.
    1. Aviation eLearning uses cookies and logs your data. User data is stored for internal processing and for Aviation eLearning’ own promotional purposes in accordance with Danish legislation.
    2. Aviation eLearning might share personal data and results upon an official request from a relevant authority. Aviation eLearning transfers registered user data to other parties only in accordance with the pertinent laws prevailing. By accepting the Terms & Conditions you give us the right to pass your data to your State Of License Issue NCAA or equivalent authority.
    3. If a breach of security that can result in a risk of personal data theft is discovered, users will be contacted within 72 hours via email.
    4. Children’s Privacy
      Our Services do not address children under the age of 13 years. We encourage minors who are lawfully allowed to avail of our service to contact us to know more about their rights under GDPR. Parents and guardians may also contact us to report any misuse by a minor under their care, so that we can respond with the necessary action.
  16. Rights
    1. Aviation eLearning has the immaterial rights to all materials/products available to the User and offered by Aviation eLearning and www.ilpt.net
    2. No parts of Aviation eLearning’ materials/products may be used externally without Aviation eLearning’ prior written consent.
  17. Transfer of rights
    1. Under the contractual obligations, neither Aviation eLearning nor the User is entitled to transfer their rights or obligations, wholly or partly, to third parties.
    2. However, notwithstanding § 15.1, other employees from the same company can utilize any remaining company-paid balance.
  18. Breach of contract
    1. If the User fails to conform with the criteria and guidelines given on www.ilpt.net prior to the test, Aviation eLearning Aps reserves the right to refuse the User of a re-test.
    2. Use of false or wrong information during the registration process will be considered a breach of contract from User, and no refund will be made.
    3. Any attempt to violate the integrity of the test concept or fixing of results will be a breach of contract, and will be forwarded to the State Of License Issue.
      Using another persons data will be considered as fraud and Aviation eLearning reserves the right to file a police report should that be required. This will be a breach of contract and will be forwarded to the State Of License Issue.
  19. Liability
    1. EXCEPT TO THE EXTENT CONTRARY TO LAW NEITHER AVIATION eLEARNING APS NOR ANY OF OUR DIRECTORS, OWNERS, EMPLOYEES, AFFILIATES, TRAVEL PARTNERS OR OTHER REPRESENTATIVES WILL BE LIABLE FOR ANY DIRECT OR INDIRECT LOSS OR DAMAGES ARISING OUT OF, OR IN CONNECTION WITH YOUR USE OF ANY INFORMATION, PRODUCTS, SERVICES AND/OR THE MATERIALS OFFERED THROUGH THIS INTERNET SITE (WWW.ILPT.NET), INCLUDING BUT NOT LIMITED TO LOSS OF DATA, INCOME, PROFIT OR OPPORTUNITY, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES, OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGES HOWSOEVER ARISING, EVEN IF AVIATION eLEARNING HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE OR SUCH LOSS OR DAMAGES WERE REASONABLY FORESEEABLE.
  20. Court of jurisdiction
    1. This agreement is according to Danish law.
    2. The court of jurisdiction for disputes relating to contracts concluded with Aviation eLearning is “Københavns Byret” (The Copenhagen City Court), unless the case is referred to “Østre Landsret” (The “Østre” High Court) or “Sø- og Handelsretten” (The Maritine and Commercial Court) in accordance with the prevailing rules and stipulations.
